RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
By booking or using services provided by Platter Pushers (“Provider”), you (“Client”) agree to the following terms:
1. Voluntary Participation
Client voluntarily engages Platter Pushers for the rental of charcuterie carts and related event services and understands the nature of such activities.
2. Assumption of Risk
Client acknowledges that participation in the rental or use of any equipment involves certain risks, including but not limited to injury, illness (including allergic reactions), property damage, or harm caused by guests or equipment misuse. Client accepts all such risks voluntarily.
3. Release of Liability
To the fullest extent allowed by law, Client releases and discharges Platter Pushers, its owner(s), employees, agents, and affiliates from any and all liability, claims, demands, or causes of action for injuries or damages (known or unknown) resulting from the use or rental of equipment or services, including those caused by negligence.
4. California Civil Code § 1542 Disclosure
Client expressly waives the provisions of California Civil Code Section 1542, which states:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in their favor at the time of executing the release and that, if known, would have materially affected the settlement.”
5. Indemnification
Client agrees to indemnify and hold harmless Platter Pushers from any and all claims, actions, damages, or expenses (including legal fees) arising from Client’s event, including guest conduct, property damage, or failure to follow safety guidelines.
6. Damage Responsibility
Client accepts full financial responsibility for any loss or damage to rental equipment caused by misuse, neglect, or lack of supervision. Additional repair or replacement charges may apply.
7. Food Allergy Notice
While Platter Pushers maintains general food safety practices, Client acknowledges that food may contain or come into contact with allergens including but not limited to dairy, nuts, gluten, and soy. Platter Pushers cannot guarantee an allergen-free environment.
8. Media Release (Optional)
Unless otherwise requested in writing before the event, Client grants permission for Platter Pushers to take photographs of the cart and display setup during the event, and to use such photos for marketing purposes.
9. Governing Law
This waiver shall be governed by the laws of the State of California. Any legal action shall be brought in a court of competent jurisdiction located in Sacramento, California.
Agreement Acknowledgment
By checking the agreement box during booking or submitting a rental inquiry, Client confirms they have read and agree to the terms of this Rental Release & Liability Waiver.
